Resumen: El derecho a la defensa exige que toda persona conozca oportunamente las
actuaciones administrativas o judiciales que puedan afectar sus derechos; sin embargo,
la existencia de una constancia de notificación o un acta de citación no demuestra, por sí
sola, que el contenido haya sido comunicado de manera íntegra y en un momento
adecuado para ejercer la defensa. El objetivo de esta investigación fue comparar la
notificación administrativa y la citación judicial en Ecuador para determinar los criterios
que permiten establecer un conocimiento jurídicamente suficiente y diferenciar una
irregularidad formal de una situación de indefensión. Se desarrolló una investigación
cualitativa, jurídico-documental y comparativa mediante el análisis de la normativa
aplicable y siete sentencias de la Corte Constitucional del Ecuador emitidas entre 2023 y
2025, seleccionadas de manera intencional según la diversidad de problemas jurídicos
examinados. Los resultados evidenciaron que ambas instituciones cumplen funciones
diferente
s respecto de su finalidad, modalidades y efectos jurídicos; no obstante,
comparten la exigencia de una comunicación verificable y oportuna que permita ejercer
el derecho a la defensa. Asimismo, se identificó que no toda irregularidad genera una
vulneración constitucional, sino únicamente aquella que limita de manera material la
posibilidad de comparecer, formular argumentos, presentar pruebas, contradecir o
impugnar. Se concluyó que la suficiencia de la comunicación debe valorarse mediante
cinco criterios: idoneidad, trazabilidad, diligencia, oportunidad e incidencia material en
la defensa, cuya integración permite orientar decisiones sobre eficacia, convalidación y
nulidad.

Abstract: The right to defense requires every person to be timely informed of administrative or
judicial actions that may affect their rights; however, the existence of a notification record or a
citation report does not, by itself, demonstrate that the content was communicated in full and at
an appropriate time to exercise the right to defense. The objective of this research was to compare
administrative notification and judicial summons in Ecuador in order to determine the criteria
that allow establishing legally sufficient knowledge and distinguishing a formal irregularity from
a situation of denial of defense. A qualitative, legal-documentary, and comparative study was
conducted through the analysis of the applicable regulations and seven rulings issued by the
Constitutional Court of Ecuador between 2023 and 2025, intentionally selected according to the
diversity of the legal issues examined. The results showed that both institutions perform different
functions regarding their purpose, procedures, and legal effects; however, they share the
requirement of a verifiable and timely communication that enables the exercise of the right to
defense. Likewise, it was identified that not every irregularity generates a constitutional violation,
but only those that materially limit the possibility of appearing, presenting arguments,
submitting evidence, challenging opposing claims, or filing appeals. It was concluded that the
sufficiency of communication should be assessed through five criteria: suitability, traceability,
diligence, timeliness, and material impact on the right to defense. Their integration provides
guidance for decisions regarding effectiveness, validation, and nullity.
